INTRODUCTION:
Welcome to the Omcraft website, operating under the brand name Divineartis, specializing in home décor products. These Terms and Conditions govern your usage of our website and any resulting transactions. By accessing or using our website, you agree to comply with and be bound by these terms. Together with the purchase agreement, Omcraft offer, order confirmation, and invoice, these terms constitute the entire agreement. The Company will not deem any order accepted until issuing a written acknowledgement. In the case of conflict regarding an order, these terms and conditions shall prevail. Sales are conducted offline.
ORDER AND SPECIFICATIONS:
It is the buyer’s responsibility to ensure all order details are accurate and complete. Upon receiving the order offline, we will confirm acceptance via email or written acknowledgement. We reserve the right to refuse orders due to unpaid invoices or unacceptable creditworthiness. Once a contract is established, it is binding, and any cancellation must occur within 3 days of receiving the order confirmation. Failure to do so may result in liability for cancellation charges. Omcraft bears no liability if delivered services do not meet the buyer’s needs.
TERMS AND PAYMENT:
Omcraft may require payment within 7 days of placing the order, with interest charged for late payment. Payments can be made via net banking or online. Late payment may incur interest as specified in the agreement. Failure to make payment within 45 days may lead to agreement cancellation and claim for damages.
COMMENCEMENT DATE:
This agreement begins upon the Company’s receipt of any order from the Buyer.
LIMITATION OF LIABILITY:
Omcraft is liable under Indian law but not for losses unless due to the company’s negligence. Debiting an amount from the buyer’s account not received by the company does not render the company liable for refund or payment. Omcraft’s liability is limited to the value of services supplied.
TERMINATION:
The Purchaser may terminate or cancel the order within 3 days of placing it.
APPLICABLE LAW AND DISPUTE RESOLUTION:
This Agreement is governed by Indian law, with any dispute to be adjudicated in Delhi, India.
SHIPPING AND DELIVERY:
Shipping options, costs, and delivery times will be determined per the agreement by both parties.
